Of course, sorry, you're right. I lazily did my testing on DIOS MIOS since I believe it uses your code. Perhaps it's not up-to-date vs. yours or something else causes the issue. Apologies for the false report.

Sorry, I can't be of any assistance with your problem, but I just wanted to point out that ToS (at least the PAL version, which I'm assuming is what you have) should work fine when forced to 480p in current builds, i.e. 136+.

Since it's mildly ambiguous what's involved in that link (e.g. there are uglier versions compiled to use the custom IOS 202 for USB, which this isn't one of), here's the Wiibrew thread where this (and a similarly recompiled version of Wii64) were first offered by bg4545.
