R trigger not working when in swiss/gcmm/gbi

I have tried everything even different version and reformatting my SD cards and starting fresh the issue still remains controller works fine in games but on the swiss menu GCMM and GBI the right trigger wont work at all I cant find any posts relating to this issue so if any one could help me. I am using SD gecko with swiss a sd2sp2 and action replay disc to boot this issue wasn't always here i thought it could be the controller but confused why it works fine in game.

so i used a GC Controller Test i had seen and when i press left it says left and number goes up to 255 now when i click right the number goes up to 255 but at the top it dont say right. so is it a controller issue?
